The Ohio Supreme Court has proposed rule changes that will redefine the term “public records” and affect access to court case records [See"Proposed amendments to the Rules of Superintendence for the Courts of Ohio Rules 44-47] Suggested changes include:

(a) Redacting the case information rather than limiting public access to the entire record;

(b) Limiting remote access to either the case record or case information while
maintaining its public access;

(c) Limiting public access to either the case record or case information for a specific period of time;

(d) Using a generic title or description for the case record or case information in a case management system or register of actions;

(e) Using initials or other identifier for the parties’ proper names.

The open records advocacy group, the Evan B. Donaldson Adoption Institute, has released a study of the consequences of restrictive and open adoption laws. The Institute concludes that new adoption laws that have given adoptees and birth parents access to the original birth certificates has advanced the policy debate “from speculation about the appropriateness, wisdom and impact of such legal changes to a more-informed consideration of their personal, practical and social effects on real people’s real lives.”

The well established may disappear overnight in the realm of online government records. Visitors to the Jefferson County, Alabama Probate Court online records search – the site for images of land records, personal property and probate recordings – were recently greeted by an unwelcome message.

Due to privacy concerns, this site is unavailable until further notice. Data is still available at the Jefferson County Probate offices.

A reporter alerted the county to the availability of Social Security numbers in some document images – mostly older UCC filings – which were not properly redacted. The site is completely down until all the SSNs can be removed.

California legislation that would have restored the public’s right to view police disciplinary information has apparently been derailed before being heard in the Assembly Public Safety Committee. The California Progress Report gives a detailed review.

The San Mateo County, California Court site has posted a Standing Order restricting personal data in court filings, in accordance with the California Rules of Court. Personal identifiers should be limited to the last 4 digits of the Social Security number, the year of birth, and initials for minor children.

Adoptees received some good news in a bill signed by the governor of Maine. Starting January 1, 2009 anyone adopted in Maine gains the right to their original birth certificate. Only 3 other states have unlocked adoption records that were formerly closed.

In the ever new species of state registries the Virginia Department of Agriculture and Consumer Services has sprouted the Dangerous Dog Registry!

The Dangerous Dog Registry provides a mechanism for consumers to determine if dangerous dogs reside in their neighborhoods and for local animal control officials to post information about dogs that have been declared dangerous by the local court.

Madera County, California real property parcel maps can be searched by address and viewed online.

The Sacramento County, California probate court is adding online document images to its Web site. Only cases filed after February 5, 2007 are currently included.

The recent expansion of the role of Arizona Ombudsman-Citizens’ Aide Office will provide a complaint center for addressing public records access violations.

The Indiana Attorney General has an online, searchable database of the legal actions they have initiated against violators of Indiana’s consumer protection laws. Search by county and/or year or view a list by defendant’s name, with links to the public filings and court orders.

The Pasco County, Florida Sheriff has added many new online tools to its Web site: Active calls log, Dispatch log, Subdivision activity log, Inmates in jail, and Outstanding warrants.

The National Archives provides links to all the state archives, which sometimes have online indexes of public records that are not at the local jurisdiction’s Web site. While these may be of more relevance to genealogists, private investigators often are charged with developing social histories for criminal defense cases, tracing beneficiaries for real estate matters, rooting out unclaimed assets or developing background on people and companies.

After you get to the state archives site look for a link to online databases or family history records if you don’t see the type of record listed you’re interested in. If the index isn’t online you can review the index and records at the state archive or receive microfilm through inter library loan. The California list of family history records includes:

COUNTY RECORDS 1850-1987. Includes probate court case files, wills, naturalizations, deeds, homesteads, and vital records for 28 counties. Not all records are available for all counties.

MENTAL HEALTH RECORDS* 1856-1972. Records may include registers and case files for Stockton, DeWitt, Modesto, Mendocino, and Sonoma State Hospitals. Some indexes available.

The Delaware Archives house state historical documents and have created an online index of probate files covering the years 1680 -1925. Search by last name, first name is optional, for a list of full names, date and county of filing.

These are not indexes to all the names appearing in the records, but only the names of the deceased for whom the files were created. Contained in each index are the individual’s name, and a date or dates. The dates correspond to the date of the documents within that individual’s file and may refer to a date of the will or to a date for probate to begin. New Castle and Kent County Probates are on self service microfilm available in our Research Room, and Sussex is in the process of being filmed (inquire with Research Room staff for details). Copies of this microfilm are also available for sale.

The Wisconsin Historical Society has an online Wisconsin Name Index to their holdings. Order document images for a fee.

The Wisconsin Name Index includes 150 county and local histories, dozen of professional directories and biographical encyclopedias, more than 60 scrapbooks containing 30,000 obituaries, and selected articles in Wisconsin magazines and newspapers. These publications were indexed by Wisconsin Historical Society librarians between roughly 1870 and 1970 but contain information on individuals from earlier date ranges. You can search the Wisconsin Name Index and purchase full text copies of available items which will be mailed directly to you.
