			<content:encoded><![CDATA[<p>The recent <a href="http://www.law.com/jsp/article.jsp?id=1202421447573"target="_blank">California Supreme Court decision</a> overturning California&#8217;s law banning same-sex marriage as unconstitutional  provides a timely discussion of the domestic partnership registry. California, among other states and municipalities provides a means for couples &#8212; variously, same or opposite sex in <a href="http://en.wikipedia.org/wiki/Domestic_partnerships_in_the_United_States"target="_blank">civil unions or domestic partnerships</a> &#8212; to register their relationship. </p>
<p>I don&#8217;t know of any online database of names of registered domestic partners, but there are <u>data sources</u>. This is the old-fashioned and still often the most reliable means of confirming a fact: call or visit the relevant government office! In California, the <a href="http://www.sos.ca.gov/dpregistry/"target="_blank">Secretary of State records the Declaration of Domestic Partnership and the Termination of Domestic Partnership</a>. This office responds to telephone inquiries and will search by a name, providing the partner name, date of registration and the residential address. You can also go to one of the offices to get a copy of either form.</p>
<p><a href="http://www.oregon.gov/DHS/ph/chs/order/dp.shtml"target="_blank">Oregon defines</a> a domestic partnership registration as a vital record, which is confidential. Domestic Partnership Registration in <a href="http://www.cityclerk.nyc.gov/html/marriage/domestic_partnership_reg.shtml"target="_blank">New York City is with the City Clerk</a>. County Recorder offices and state health departments are also repositories for these filings. Some cities, counties and states that have civil union or domestic partnership laws are listed <a href="http://family.findlaw.com/living-together/living-together-domestic-partnerships/domestic-partnerships-state-laws.html"target="_blank">here</a>.
</p>
<p>Currently, there are 49,550 registrations on file at the California Secretary of State. Of these, about 5,600 have filed terminations. By law, this office only accepts terminations up to 5 years after registration. Beyond that time, couples must go to court to end a domestic partnership.</p>

			<content:encoded><![CDATA[<p>It looks like the <a href="http://tinyurl.com/42t5n9"target="_blank">  California Assembly bill</a> that would have created an Internet <a href="http://pibuzz.com/2008/01/26/violence-registries/"target="_blank">Domestic Violence Registry</a> has excised that feature from the recent draft.</p>
<p>The California Sheriffs&#8217; Association <a href="http://www.calsheriffs.org/Documents/April2008Magazine.pdf"target="_blank">has announced</a> that VINELink will soon include all California counties, not just the 17 that are currently at that site. <a href="http://vinelink.com"target="_blank">VINELink</a> provides real-time status of offenders in county jails.</p>
<p>Private investigators will have more difficulty finding people in California if proposed legislation, <a href="http://tinyurl.com/5sp6jl"target="_blank">Senate Bill 1423</a>, becomes law. The bill titled, &#8220;Unlisted telephone numbers&#8221;, would ban phone companies from charging a fee to their subscribers who wish to have their phone numbers unlisted or nonpublished. In that case, won&#8217;t everyone in California request that their telephone number listing be private?</p>
<p><a href="http://www.law.com/jsp/article.jsp?id=1202421322356"target="_blank">The 11th U.S. Circuit Court of Appeals ruled in favor of a law firm that obtained Florida vehicle record information for litigation purposes.</a> The plaintiff had claimed that the firm violated the federal Driver&#8217;s Privacy Protection Act in purchasing his vehicle ownership data, but the court said that the law firm met one of the permitted exceptions. However, pending cases may lead to settlements in which ChoicePoint (and other public record providers) voluntarily agree to limit the personal information they release, even if the sale of the data complies with the law.
</p>
<p>The <a href="http://ipcenter.bna.com/pic2/ip.nsf/id/BNAP-7E9JTJ?OpenDocument"target="_blank">Ohio Supreme Court ruled in favor of a newspaper which sought a list of names and addresses of foster care providers </a>maintained by a state family services agency. In a complicated intersection of Ohio state public records access law and federal funding restrictions, the agency must determine which records meet the Social Security Act exception to disclosure.</p>

Salaries of earners over $100, 000 can be searched by name or agency at the Marin Independent Journal. I have <a href="http://pibuzz.com/whats-new-at/"target="_blank">a link to this and all other salary databases</a> across the USA that I&#8217;ve been able to identify.

<p>The <a href="http://ago.mo.gov/newsreleases/2008/AG_Nixon_seeks_A1_Peoplesearch_web_site_shut_down/"target="_blank">Missouri Attorney General is seeking to shut down Web sites that sell personal information, such as Social Security numbers, to the general public on Missouri residents</a>. The current lawsuit names A1 Peoplesearch, LLC. A recently prior action seeks to stop Publicdata.com from selling the same type of personal information. Even though the companies are based outside Missouri they are selling data with Social Security numbers and dates of birth of Missouri residents. The Jackson County Circuit court <strong><a href="http://ago.mo.gov/newsreleases/2008/MO_AG_obtains_restraining_order_against_A1Peoplesearch/"target="_blank">issued a restraining order last week prohibiting A1peoplesearch</a></strong> &#8220;from selling such information about Missourians or allowing consumers to search its database using Missourians&#8217; Social Security numbers.&#8221;
</p>
<p>The New Jersey Supreme Court has broken new ground in <a href="http://www.judiciary.state.nj.us/opinions/supreme/A-105-06%20State%20v%20Shirley%20Reid.pdf"target="_blank">its ruling</a> that Internet service providers <strong><a href="http://government.zdnet.com/?p=3769"target="_blank">cannot release users&#8217; personal information without a valid subpoena.</a></strong> A local police department investigating a possible computer access crime submitted a subpoena to the Internet Service Provider that wasn&#8217;t associated with any filed court case. The court determined that under the New Jersey constitution residents have more extensive privacy rights than provided in the U.S. constitution.

You&#8217;ll find any type of medical service provider who accepts Medicare or Medicaid. Search by partial name, city, state or zip code. Results may include home address, business address and telephone number, type of service offered, professional license type and number, and the states in which they are licensed. </p>
<p>The database isn&#8217;t limited to licensed professionals; it also includes case managers and addiction recovery service staff, among others. Some non doctor licensees include acupuncturists, chiropractors, physical therapists and nurses.</p>
<p>Addiction recovery counselors in California may be certified by any <a href="http://www.adp.cahwnet.gov/Licensing/LCBhome.shtml"target="_blank">accredited organization</a>. Two certification databases are at the <a href="http://www.caadac.org/pages/certification/registry.php"target="_blank">California Certification Board of Alcohol and Drug Counselors</a> and the <a href="http://www.caarr.org/index.php?option=com_content&#038;task=view&#038;id=67&#038;Itemid=76"target="_blank">California Association of Addiction Recovery Resources. </a> Find people working as alcohol and drug counselors, who may not be certified, at the <a href="http://www.americanacademy.org/resources/membersearch.aspx"target="_blank">American Academy of Health Care Providers in the Addictive Disorders database.</a> This site also lists the employers.

			<content:encoded><![CDATA[<p>Pacific Information Resources, Inc., familiarly known as Search Systems, has released <strong><a href="http://www.searchsystems.net/free-criminal-records-search-guide.php"target="_blank">a guide to researching criminal records</a></strong>. The document is viewable online and can also be downloaded as a PDF. Search Systems provides links to commercial and government-operated databases of public record information on the Internet. Most of these are free, but access to the huge collection has a small fee.</p>
<p>The site categorizes links to all imaginable public records that are available on the Internet. Some popular types of public records included are: Births, Marriages and Deaths, Corporations, Court Records, Fictitious Business Names, Professional Licenses, Real Property, Recorded Documents, and Voter Registrations.
</p>
<p>The Criminal Records Search Guide addresses the myth of a nationwide criminal records database and lists the different types of criminal records and their agency source. It also identifies non court records of sanctions and enforcement databases. This is a basic tutorial, designed for the casual or non professional researcher.
</p>
<p>But the primary emphasis is on the Search Systems collection of criminal records &#8212; both the free links, called <a href="https://signup.searchsystems.net/register.php"target="_blank">DirectPass</a>, and the fee-based criminal records database, part of the <a href="https://premium.searchsystems.net/"target="_blank">Premium</a> searches. Premium searches are discounted for DirectPass subscribers, but incur an additional fee. </p>
<p>The Premium criminal records content is from a commercial database but is reformatted by Search Systems, usable as a cut-and-paste text document. The text formatting enhances this product over the html one of the data provider. Search by full or partial first and last name, with an option to limit by date of birth or year of birth. The cost is $7 per state search or $19 for a search of all available jurisdictions, if you are a subscriber to DirectPass.</p>
<p>The most comprehensive search of criminal records will utilize the free government-sponsored sites &#8212; those listed in the DirectPass collection and Internet sources that haven&#8217;t yet found their way into the Search Systems public records. Also, a comprehensive search for criminal records must include a commercial database &#8212; probably 2 to 3 databases, depending on the jurisdiction one is searching. There is no substitute for hand searching court records, whether or not the particular jurisdiction is encompassed in the online records.</p>

<p>The <a href="http://www.idfpr.com/newsrls/04042008PhysicianProfilePressRelease.asp"target="_blank">announcement</a> of the database was issued by Gov. Blagojevich:</p>
<blockquote><p>Over 85 percent of all licensed physicians and surgeons have provided the information necessary to create their profile in categories that include: the location and scope of practice, the type of insurance the physician accepts, specialties and certifications, legal and disciplinary actions taken against the physician, his or her educational background and any professional activities or honors the physician would like to add.   Physicians’ licenses are subject to renewal in July 2008. Before a license is renewed, physicians must provide the information for their profiles.</p>

<p>The New Jersey Supreme Court Committee on Public Access to Court Records recently solicited comments on its proposed policy changes. Read the <strong><a href="http://www.judiciary.state.nj.us/publicaccess/"target="_blank">submitted comments</a></strong> and the <strong><a href="http://www.judiciary.state.nj.us/publicaccess/publicaccess.pdf"target="_blank">report</a></strong> on policy changes.</p>
<p>An <strong><a href="http://www.ag.state.nd.us/documents/2008-O-07.pdf"target="_blank">Opinion issued by the North Dakota Attorney General</a></strong> confirms that email messages from government employees &#8220;acting within the scope of their public positions&#8221; are public records &#8220;regardless of whether it is located at their private homes or businesses.&#8221;

			<content:encoded><![CDATA[<p>While some people may endeavor to scrub their online reputation, <a href="http://pewresearch.org/databank/dailynumber/?NumberID=462"target="_blank">most people aren&#8217;t concerned</a> about personal information on the Internet. Investigators make use of formally and unintentional, detrimental and laudatory personal information that&#8217;s posted online to check the background of witnesses, jurors, plaintiffs, defendants, insurance claimants, potential business associates or employees and anyone whose reputation and activities must be known. That&#8217;s a deep pool, and the Internet can offer a lot that isn&#8217;t otherwise easily accessible.
</p>
<p>Government agencies that regulate professional licenses are increasingly putting violations by licensees on their Web sites. But don&#8217;t overlook private associations of professionals that discipline their members, because they may have descriptions of alleged wrongdoing that go beyond that on the government Web site. Take a look at the <a href="http://www.aicpa.org/pubs/cpaltr/disciplinary_actions/disc2001.htm#May"target="_blank">American Institute of Certified Public Accountants (AICPA) disciplinary action for a David J. Burton</a> (use your &#8220;find&#8221; tool). Now look at the State of Illinois, Division of Professional Regulation <a href="https://www.idfpr.com/dpr/licenselookup/results.asp"target="_blank">entry</a>.  He was charged with a violation of the code of ethics of AICPA, but the government site doesn&#8217;t have a record of this.</p>
<p>Generally, you find citations and enforcement actions at the Web site of the agency that regulates the specific profession. Select the profession in the drop-down menu at the <a href="https://doraimage.state.co.us/LibertyIMS::/sidN3Pc4O9J86w50TC3/Cmd%3D%24%24FDBDenO%5FD%2DSpPpdt4%3BohV1%3D%23cGa"target="_blank">Colorado</a> State site for a list of license violations. This is a badly designed site, without a search by name mechanism. I have the same complaint about the <a href="http://www.ncrec.state.nc.us/bulletin/bulletin.htm"target="_blank">North Carolina Real Estate Commission disciplinary actions</a>, but those can be uncovered with a search engine query.

But the record detail provides extensive information on the place of arrest, the arresting agency and report number, criminal charges, upcoming court hearings, personal data (including alias&#8217;) and physical description.</p>
<p>The site advises that inmates &#8220;in certain circumstances, may not appear on this site based on exemptions provided under Government Code section 6254(f).&#8221;

Search by state or zip code. Or search by name from a search engine with the query:  name site:uscis.gov. Replace the word name with the personal name.</p>

A search by last name or year returns name, location, date of arrest, conviction result, DEA registration status and a case summary. This database goes back to 2003. Search older registrant actions from a search engine with the query: name site:www.deadiversion.usdoj.gov/.

Baltimore, Maryland recently approved legislation that would <strong><a href="http://baltimorecity.gov/news/press/1007/100107%20Gun%20Offender%20Registry.pdf"target="_blank">create a public Gun Offenders Registry</a></strong>, requiring those convicted of gun related offenses register their name, address, and photograph with the police department. As yet, a Web database is not available. </p>
<p>California could become the first state to have a <strong><a href="http://www.mercurynews.com/politics/ci_7995420?nclick_check=1"target="_blank">Domestic Violence Offenders Registry</a></strong>.</p>
<p><strong><a href="http://pibuzz.com/2007/02/07/minnesota-joins-tennessee-creating-a-meth-makers-registry/"target="_blank">Minnesota,  Tennessee</a></strong> and <strong><a href="http://pibuzz.com/2007/06/24/illinois-meth-manufacturer-database-online/"target="_blank">Illinois</a></strong> have Methamphetamine Offenders Registries. <strong><a href="http://pibuzz.com/2006/08/25/this-week-in-public-records-california-iowa-utah-oregon-montana/"target="_blank">Montana</a></strong> includes convicted meth manufacturers in its Sexual and Violent Offender Registry. <a href="http://docapp8.doc.state.ok.us/servlet/page?_pageid=224,228&#038;_dad=portal30&#038;_schema=PORTAL30"target="_blank">Oklahoma lists the offenses</a> that require registration in its Sex and Violent Crime Offender Registry. <a href="http://www.legis.state.ga.us/legis/2007_08/sum/hb793.htm"target="_blank">Georgia</a>, Kansas <a href="http://www.lrc.ky.gov/RECORD/08RS/HB96.htm"target="_blank">Kentucky and </a> <a href="http://www.cga.ct.gov/asp/cgabillstatus/cgabillstatus.asp?selBillType=Bill&#038;bill_num=708&#038;which_year=2007&#038;SUBMIT1.x=13&#038;SUBMIT1.y=11&#038;SUBMIT1=Normal"target="_blank">Connecticut</a> briefly considered adding a violent offender registry to their roster of convicted criminal databases. Similar legislation is still alive in  <strong><a href="http://www.capitol.hawaii.gov/session2008/Bills/SB2337_.htm"target="_blank">Hawaii</a></strong>.</p>

The Illinois State Police maintains the <strong><a href="http://www.isp.state.il.us/cmvo/"target="_blank">Child Murderer and Violent Offender Against Youth Registry</a></strong>. </p>
<p>The flush of interest in drug dealer registration faded in Maine, New Mexico and Illinois last year, but is still alive in <a href="http://assembly.state.ny.us/leg/?bn=A08824"target="_blank"><strong>New York</strong>. <a href="http://www.dwiresourcecenter.org/datacenter/namenshame/shame.shtml"target="_blank">New Mexico has a DWI Offender Database.</a> </p>
<p>Find out if a Michigan drivers license is valid or has been suspended or revoked by searching the <a href="https://services.sos.state.mi.us/RepeatOffender/Inquiry.aspx"target="_blank">Repeat Offender Inquiry</a>. </p>
<p>And, on the meth makers theme, the <strong><a href="http://www.usdoj.gov/dea/seizures/index.html"target="_blank">DEA National Clandestine Laboratory Register</a></strong>, &#8220;contains addresses of some locations where law enforcement agencies reported they found chemicals or other items that indicated the presence of either clandestine drug laboratories or dumpsites.&#8221;</p>

			<content:encoded><![CDATA[<p>The free real property databases are extending their geographical coverage and the types of features that delight investigators. <strong><a href="http://www.zillow.com/"target="_blank">Zillow</a></strong> has a fly-on-the-cyber-wall feature that will be appreciated by lawyers and investigators: number of total and recent month page views for a particular property. Find it at the bottom of the &#8220;Home Facts&#8221; detail page. The last sales date and sales price is available on both Zillow and <strong>Cyberhomes</strong>, but I found the data more often on Zillow. This site will also show a list of all houses on a specified street, with a link to the home details.</p>
<p><strong><a href="http://www.cyberhomes.com"target="_blank">Cyberhomes</a></strong> has a more modern look, but if you&#8217;re not especially interested in comparables, Zillow probably offers more for an investigator. Cyberhomes does have an easy to find neighborhood snapshot of census-derived demographic data. The comps and photos, available at both sites, give a quick sense of the neighborhood economic profile.</p>
<p>Free registration at <strong><a href="http://www.propertyshark.com"target="_blank">PropertyShark</a></strong> will get you 6 free lookups a day that return property owner name and last sales price. Unfortunately, the county Assessors&#8217; Web sites often don&#8217;t provide the owner name, even though it&#8217;s a public record. PropertyShark may not have this for all addresses, so you might want to use the free owner lookup at <strong><a href="http://CourthouseDirect.com"target="_blank">CourthouseDirect</a></strong>.</p>
<p>View your selected slice of real estate on a map at Live, Google, Yahoo, MapQuest or TerraServer at PropertyShark. There&#8217;s also a link to the Department of Justice, National Sex Offender Public Web Site.

<p>A few reminders: Not all regions or addresses are included in any of the free sites, which is true for fee-based databases, as well. Some Web sites are missing large geographical areas or addresses on a street. Also, if you&#8217;re searching property records as part of an investigation, utilize multiple sources - free and fee-based - and dig into the Assessor and Recorder supplied records. Check their online and onsite records. There are differences.
